align=\"center\" style=\"font-size:20px;\">INSTRUCCIONES GENERALES<\/h2>\n<p><ol align=\"justify\" style=\"line-height:20px;\">\n<li>\nEst\u00e1 sujeta a pago de Patente toda persona (individuo, fideicomiso, sucesi\u00f3n, sociedad, corporaci\u00f3n, etc.) Dedicada con fines de\nlucros a la prestaci\u00f3n de cualquier servicio, a la venta de cualquier bien, a cualquier negocio financiero o a cualquier industria o\nnegocio en los municipios del Gobierno de Puerto Rico, excepto lo que en otro sentido dispone la Ley.\n<\/li>\n<li>\nToda persona sujeta al pago de Patentes, o su agente autorizado, deber\u00e1 rendir una Declaraci\u00f3n Sobre Volumen de Negocios en o\nantes de los cincos (5) d\u00edas laborables siguientes al quince (15) de abril de cada a\u00f1o o a la fecha establecida por el Departamento de\nHacienda para la radicaci\u00f3n de las planillas de contribuci\u00f3n sobre ingresos.<\/li>\n<li>\nEl pago de Patente vencer\u00e1 en plazos semestrales el 1ro de julio y 1ro de enero de cada a\u00f1o. Se conceder\u00e1 un descuento por pago\nanticipado de 5% a aquellos contribuyentes que paguen la Patente en su totalidad en o antes de los cinco (5) d\u00edas laborables\nsiguientes al 15 de abril de cada A\u00f1o Contributivo o a la fecha establecida por el Departamento de Hacienda para la radicaci\u00f3n de las\nplanillas de contribuci\u00f3n sobre ingresos.\n<\/li>\n<li>\nEst\u00e1n exentos del pago de Patente, entre otros, los servicios, ventas, negocios financieros y\/o cualquier industria o negocio cuando su\nvolumen de negocios no exceda de cinco mil d\u00f3lares (5,000).\n<\/li>\n<li>\nLa casa u oficina principal preparar\u00e1 una Declaraci\u00f3n por el Volumen de Negocio llevados a cabo en el municipio donde radica la\nmisma, incluyendo en dicha Declaraci\u00f3n las Operaciones de Sucursales en el mismo municipio, si alguna. Se preparar\u00e1n adem\u00e1s\ndeclaraciones por separado por el Volumen de Negocios llevados a cabo en otros municipios donde la casa u oficina principal tenga\nsucursales, oficinas, almacenes, etc. Todas las declaraciones se rendir\u00e1n al Director de Finanzas del municipio donde radica la casa\nprincipal y copia de cada declaraci\u00f3n al municipio que corresponda.\n<\/li>\n<li>\nPor A\u00f1o de Contabilidad se entender\u00e1 el A\u00f1o Natural o A\u00f1o Econ\u00f3mico terminado dentro de dicho A\u00f1o Natural.\nEl A\u00f1o de\nContabilidad ser\u00e1 igual al utilizado para preparar y rendir la Planilla de Contribuciones sobre Ingresos.\nSi no se rinde planilla,\nentonces el A\u00f1o de Contabilidad ser\u00e1 el A\u00f1o Natural.\n<\/li>\n<li>\nEn la Partida 1, Encasillado 2, se incluir\u00e1 el Volumen de Negocios de cualquier servicio prestado aunque no tenga oficina establecida.\n<\/li>\n<li>\nSe entender\u00e1 por \"servicio\" aquellas operaciones llevadas a cabo por toda industria o negocio de prestaci\u00f3n del servicio al usuario o\nconsumidor, inclusive pero no limitado a los servicios profesionales. El t\u00e9rmino \"venta\" significa aquellas operaciones llevadas a cabo\npor toda industria o negocio consistente en la venta de bienes al detal o al por mayor.\n<\/li>\n<li>\nEl Ingreso Bruto Devengado por los bancos comerciales, asociaciones de ahorro y pr\u00e9stamo, bancos mutualistas o de ahorro sujetos\nal Pago de Patente se distribuir\u00e1 entre las sucursales de acuerdo con la proporci\u00f3n que guarden todas las Clases de Dep\u00f3sito de la\nSucursal con los Dep\u00f3sitos Totales de la Organizaci\u00f3n de Puerto Rico.\n<\/li>\n<li>\nEn Encasillado 4, \"Otros Negocios Financieros\", se incluir\u00e1 toda industria o negocio consistente en servicios y transacciones de\ncompa\u00f1\u00edas de financiamiento, compa\u00f1\u00edas de inversi\u00f3n, agencias de cobro y cualquier otra actividad financiera llevada a cabo por\ncualquier industria o negocio.\n<\/li>\n<li>\nSer\u00e1 requisito el que se acompa\u00f1e junto con la Declaraci\u00f3n, copia de la Certificaci\u00f3n de Galones de Gasolina comprados, y el\nporciento de Beneficio Bruto bajo las cuales operaron.\n<\/li>\n<li>\nSi el Volumen de Negocios es de tres millones de d\u00f3lares (3,000,000) o m\u00e1s, la Declaraci\u00f3n deber\u00e1 estar Certificada por la persona o\nsu Agente Autorizado, y DEBE ACOMPA\u00d1ARSE DE UN ESTADO DE GANANCIAS Y P\u00c9RDIDAS, ESTADO DE SITUACI\u00d3N Y\nESTADO DE FLUJO DE FONDOS, AUDITADOS POR UN CONTADOR P\u00daBLICO AUTORIZADO, correspondiente al A\u00f1o de\nContabilidad inmediatamente, anterior. Si el Volumen de Negocio es menor de un mill\u00f3n de d\u00f3lares (3,000,000), la Declaraci\u00f3n DEBE\nACOMPANARSE CON UNA COPIA DE LA P\u00c1GINA O ANEJO DONDE SE DETALLAN LOS INGRESOS BRUTOS Y GASTOS DE\nOPERACIONES SEG\u00daN FUERON SOMETIDOS AL SECRETARIO DE HACIENDA PARA FINES DE LA PLANILLA DE\nCONTRIBUCI\u00d3N SOBRE INGRESOS. Estos documentos deber\u00e1n estar acompa\u00f1ados de una Certificaci\u00f3n del Contribuyente (ver\np\u00e1gina 1 de la Declaraci\u00f3n) de que los mismos son copia fiel y exacta de los radicados ante el Departamento de Hacienda en la\nPlanilla de Contribuci\u00f3n sobre Ingresos.\n<\/li>\n<li>\nLa Declaraci\u00f3n de Volumen de Negocios deber\u00e1 ser jurada ante cualquier funcionario municipal o del Estado Libre Asociado de Puerto\nRico autorizado para ello.\n<\/li>\n<li>\nSe penalizar\u00e1 por no rendir esta Declaraci\u00f3n dentro del t\u00e9rmino prescrito por ley, a menos que se demuestre que tal omisi\u00f3n se debe\na causa razonable y que no se debe a descuido voluntario.
